This purchase agreement is between Poppins Puppies, LLC ("seller"), and the "buyer" below:
UPON COMPLETION OF THIS AGREEMENT AND PAYMENT of a $1500 deposit, to count toward the total purchase price of $4800, plus Utah Sales Tax, the seller will reserve a specific puppy for buyer.
TERMS AND CONDITIONS

1. Deposit, Payment of Purchase Price, Fees
Buyer has paid a non-refundable deposit of $1500, to go toward the total price of $4800 plus UT sales tax. The remaining balance of $3300 (plus UT sales tax on total purchase price) is due before puppy goes to new home. Puppy needs to be taken during "take-home dates" unless specifically arranged with Seller, or deposit will be forfeited, and puppy will be sold to another buyer. 2. Seller’s Representations and Warranties
Seller represents and warrants to Buyer that:
(a) Seller is the legal and true owner of the Dog and that Seller has full right and authority to sell the Dog.
(b) The Dog is being sold free and clear of any lien, security interest, charge or other encumbrance.
(c) The Dog is free of life-threatening diseases and disabilities for one week after delivery to Buyer. Dog will be up to date on shots and de-wormings. Buyer will be provided vaccination records and signed veterinary report.
(d) Buyer has 72 hours from the delivery date to have the Dog examined by a licensed veterinarian, at Buyer’s sole cost. If the veterinarian determines the dog is not in good health, Buyer may return the Dog, with a written signed statement from two veterinarian offices, for a full refund. Failure by Buyer to have the Dog examined within the 72 hour period will nullify this warranty. If Buyer chooses to keep the puppy, no replacement will be given and all medical costs and treatment are sole responsibility of the Buyer. This health guarantee will be null and void.
(g) Puppies are de-wormed regularly from birth throughout their time with us. Puppy will be due for another de-worming at 9 weeks of age. Giardia, Coccidia, and Parasites occur commonly in puppies. Should these be found in the puppy’s fecal test at 9 weeks, simple treatment and de-worming is to be expected as a regular part of puppy maintenance. Umbilical hernia or luxating patellas can often resolve as the puppy grows, and are not considered a defect warranting returns. Ear infections are very common in this breed
(h)Breeder provides a two year health guarantee for life threatening/significantly life altering genetic disease tested for in Embark comprehensive canine panel. Disease must be documented in writing by two veterinarians. In this case, a full refund or a replacement puppy will be offered, to be determined as appropriate by seller and breeder.
(i) Seller will NOT replace a puppy due to heat stroke, abuse/neglect, low blood sugar due to lack of nutrition, improper socialization, fractures, or other impairments caused by improper exercise or lack thereof.
3. Buyer’s Representations
Buyer represents to Seller that:
(a)The Dog will reside with Buyer as companion pet to Buyer and Buyer’s family.
(b)Buyer will keep the Dog in an enclosed area of adequate size and will not allow the Dog to roam at will. Buyer will not keep the Dog chained or tethered or permanently house the Dog in a kennel.
(c) Buyer will provide the Dog with high quality nutritious food, appropriate exercise, necessary grooming, and necessary veterinary care, including deworming, heartworm prevention and regular vaccinations (including rabies).
(d) Buyer will purchase and engage in education and puppy training exercises as provided by BAXTER & Bella, or another reputable professional trainer or training program. Buyer practices and behaviors largely influence the personality and happiness of puppy, and proper training of both Buyer and Puppy is required.
(d) Buyer is not acting as agent for any other person or business in the purchase of the Dog.
(e) Buyer will not sell, give, or release the Dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility.
(f) Buyer confirms dog shall not be used for breeding, and dog will be spayed/neutered before the age of one year. Under no circumstances will the puppy be bred, and buyer will be provide seller with proof of spay/neuter via signed documentation of Veterinarian by the time the puppy is 12 months of age.
(g)In the event Buyer sells the Dog to a new owner, Buyer shall ensure that the new owner agrees in writing to comply with the terms of this Agreement. Breeder shall be offered first right of purchase, at full original purchase price.
(h) Buyer understands that size cannot be guaranteed, but is estimated based on size of parents and charted adult weights based on puppy weights. Buyer understands that Mother Nature is ultimately in charge of size, color, etc over time.

This document is a legally binding document. Any court costs and attorney fees necessary to enforce this contract shall be paid by buyer in the state of Utah. The laws of the State of Utah, County of Utah, United States of America will govern the interpretation of this contract. Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement. Health Guarantee applies to original buyer only, and is not transferrable.

I, the Buyer of Dog from Poppins Puppies, LLC hereby acknowledge by signing below that I have read, understand, and agree to the terms of this contract in its entirety. Poppins Puppies is legally bound by writing and providing this contract to buyer.
